1. Scope

These Terms of Use apply to the use of the iOS application “FOC – Ferdinands Outdoor Companion” (hereinafter “the App”), developed by Ferdinand Drobik (hereinafter “the Developer”).

By downloading, installing, or using the App, you agree to these Terms of Use.

These Terms apply in addition to the terms and conditions of the Apple App Store.

2. Description of the App

FOC is an informational and utility app related to outdoor activities and survival knowledge.

The App may provide:

• educational articles
• practical calculators
• checklists
• equipment evaluations
• outdoor guides and instructions

The App is available in German, English, and Danish.

3. No Professional Advice

The content of the App is provided for general informational and educational purposes only.

It does not replace:

• professional medical treatment or certified first-aid training
• professional outdoor or survival training
• official safety instructions or warnings from authorities
• individual advice from qualified professionals

In particular, articles about first aid, survival techniques, water purification, and foraging do not replace practical training.

Any actions taken based on information provided in the App are taken at your own risk.

4. Disclaimer of Liability

To the maximum extent permitted by law, the Developer shall not be liable for:

• injuries or damages resulting from the use or application of techniques, tips, or instructions described in the App
• inaccuracies or incomplete information
• results generated by calculators within the App (e.g. daylight, water needs, temperature estimations, packing lists), which provide estimates only
• content on external websites accessed through links within the App
• content of embedded YouTube videos, which are the responsibility of their respective creators
• loss of locally stored data such as checklists or emergency contacts due to device failure, software errors, or accidental deletion

Use of the App is entirely at your own risk.

5. Intellectual Property

All content of the App, including but not limited to:

• texts
• layout and design
• icons
• graphics
• software code

is the intellectual property of the Developer and protected by copyright law.

No part of the App may be reproduced, distributed, or used commercially without prior written permission.

6. License to Use the App

The App is licensed, not sold, to you.

You receive a non-exclusive, non-transferable license to use the App for personal purposes on Apple devices you own or control, in accordance with the Apple Standard End User License Agreement (EULA).

7. Availability and Updates

The Developer aims to keep the App functional and up to date.

However, the Developer does not guarantee that the App will always be:

• available
• free of errors
• uninterrupted

Updates may change, improve, or remove certain features.

8. Equipment Evaluations

Equipment reviews contained in the App reflect the personal experiences and opinions of the Developer.

They do not constitute purchasing recommendations.

The Developer does not receive sponsorships or advertising compensation from the mentioned manufacturers or brands.

9. Governing Law

These Terms of Use are governed by the laws of the Kingdom of Denmark, to the extent permitted by applicable law.

10. Changes to the Terms

The Developer reserves the right to update these Terms of Use at any time.

The current version will always be available within the App and in the App Store.

Continued use of the App after changes constitutes acceptance of the updated Terms.
